This Privacy Policy describes how Kortex 360 ("Kortex," "we," "us," or "our") collects, uses, and protects information in connection with our website at kortex360.com (the "Site") and the services we provide (the "Services"). This Privacy Policy applies to information we collect from business visitors to our Site, prospects, clients, and end users of our Services.

Summary. We collect information to operate our business, deliver and improve our Services, and communicate with our clients and prospects. We do not sell your personal information, and we do not share it with third parties for their own marketing purposes. The information we collect is used for our own internal business purposes, including proprietary business development methods.

1. Information We Collect

We collect information in several categories, described below.

1.1 Information You Provide Directly

When you contact us, request information, execute a service agreement, or use our Services, you may provide:

  • Identifiers such as name, business name, email address, phone number, and mailing address;
  • Job title, role, industry, and information about your business;
  • Information about your current tools, workflows, challenges, and goals, shared during discovery calls, onboarding, or ongoing engagements;
  • Payment and billing information, processed through our third-party payment processor (see Section 3);
  • Account credentials and access tokens that you authorize us to use in order to integrate with your third-party platforms (such as CRM, calendar, email, phone, or hosting providers);
  • Communications, feedback, and any other information you choose to provide.

1.2 Information Collected Automatically

When you visit the Site or interact with our Services, we may automatically collect:

  • Log and device information such as IP address, browser type and version, operating system, referring URL, and timestamps;
  • Usage information such as pages viewed, links clicked, time spent on pages, and navigation patterns;
  • Cookie and similar tracking technology data (see Section 6).

1.3 Information Collected Through Our Services

In the course of delivering Services, we may process information on behalf of our clients, including:

  • Information about leads, prospects, and customers of our clients, such as names, phone numbers, email addresses, and the content of calls, messages, or form submissions;
  • Call recordings and transcripts generated by AI voice and receptionist systems;
  • SMS, email, and other communications handled by our automation and qualification systems;
  • Review content, customer feedback, and related interactions captured through our review generation services.

Client Responsibility. Where we process information about a client's leads or customers, we act as a service provider or processor on behalf of the client. The client is responsible for having an appropriate legal basis (including required consents under TCPA, CAN-SPAM, and applicable privacy laws) to direct us to process that information.

1.4 Information From Third Parties

We may receive information about businesses and business contacts from publicly available sources, commercial data providers, professional networks, and public business directories, for the purpose of business development and prospecting. This information generally relates to business contact details and publicly available firmographic data about businesses.

2. How We Use Information

We use the information we collect for the following purposes:

  • To provide, operate, maintain, and improve the Site and the Services;
  • To communicate with you about proposals, service agreements, projects, invoices, support, and administrative matters;
  • To deliver the Services our clients have engaged us to provide, including lead qualification, automation, receptionist, review generation, and related services;
  • For our own internal business development, including research, outreach, prospecting, and refinement of our proprietary methodologies, workflows, and systems;
  • To analyze usage and performance of the Site and the Services, and to improve them;
  • To enforce our Terms of Service, protect against fraud or misuse, and meet legal obligations;

Proprietary Internal Use.

Information we collect is used for our own internal proprietary methods, including business development, strategy, service improvement, training our systems, and operational analytics. We use this information to improve the quality of our Services and to identify opportunities for our business. We do not sell or rent this information to third parties.

3. How We Share Information

We do not sell your personal information. We do not share your personal information with third parties for their own marketing purposes.

We may share information in the following limited circumstances:

  • Service Providers. We share information with trusted third-party service providers who perform functions on our behalf, such as hosting, payment processing (Stripe), electronic signature (DocuSign, BoldSign), cloud storage, email delivery, CRM, analytics, telephony, AI voice platforms, and automation platforms. These providers are authorized to use your information only as necessary to provide services to us.
  • Client Integrations. Where our Services integrate with platforms you direct us to use (such as your CRM, calendar, or phone system), information is shared with those platforms at your direction.
  • Legal and Safety. We may disclose information if required by law, subpoena, court order, or other legal process, or if we believe in good faith that disclosure is necessary to protect our rights, property, or safety, or the rights, property, or safety of others.
  • Business Transfers. In connection with a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred to the acquiring or successor entity. We will provide notice of any such transfer.
  • With Your Consent. We may share information for any other purpose with your consent or at your direction.

4. Payment Processing

Payments for our Services are processed by third-party payment processors, including Stripe, Inc. We do not store full payment card numbers on our systems. Payment information is handled in accordance with the payment processor's privacy policy and applicable PCI DSS standards. 5. Data Retention

We retain information for as long as necessary to fulfill the purposes described in this Privacy Policy, including to provide our Services, comply with our legal obligations, resolve disputes, and enforce our agreements. Retention periods vary depending on the nature of the information and the purpose for which it was collected. When information is no longer needed, we will delete, anonymize, or securely store it until deletion is practical.

6. Cookies and Tracking Technologies

The Site uses cookies and similar tracking technologies to operate and improve the Site, remember preferences, and analyze traffic. We may use:

  • Opt out of marketing communications by following unsubscribe instructions in our emails or contacting us.

To exercise any of these rights, contact us using the information in Section 13. We will respond within the timeframe required by applicable law. We may need to verify your identity before fulfilling a request.

8.1 California Residents

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including the right to know what personal information we collect, the right to delete personal information, the right to correct inaccurate personal information, and the right to opt out of the sale or sharing of personal information. As noted above, we do not sell or share personal information for cross-context behavioral advertising.

9. Children's Privacy

Our Services are directed to businesses and are not intended for individuals under the age of eighteen (18). We do not knowingly collect personal information from children. If you believe we have inadvertently collected information from a child, please contact us and we will promptly delete it.

10. Third-Party Links and Services

The Site and Services may contain links to, or integrate with, third-party websites, platforms, and services. This Privacy Policy does not apply to those third parties. We are not responsible for the privacy practices of third parties, and we encourage you to review their privacy policies before providing them with any information.

11. International Users

The Services are operated in the United States. If you access the Services from outside the United States, you understand that your information will be transferred to, stored, and processed in the United States, where privacy laws may differ from those in your jurisdiction. By using the Services, you consent to such transfer and processing.

We may update this Privacy Policy from time to time. When we do, we will update the "Last Updated" date at the top of this page. Material changes will be communicated by posting a notice on the Site or by email. Your continued use of the Site or Services after the effective date of the revised Privacy Policy constitutes your acceptance of the changes.
